GENERAL TERMS AND CONDITIONS OF WWW.DAMPOL.EU
I. Definitions
The terms used in these regulations have the following meanings:
1. Customer - a natural person, legal person, or organizational unit that is not a legal person but whose specific provisions grant legal capacity and which places an order within the store;
2. Civil Code - Act of April 23, 1964 (Journal of Laws No. 16, Item 93, as amended);
3. Regulations - These regulations govern the provision of electronic services through the online store www.dampol.eu;
4. Online Store (Store) - a website at www.dampol.eu through which the Customer can, in particular, place orders;
5. Goods - products presented in the online store;
6. Purchase Agreement - a contract for the sale of goods, as defined in the Civil Code, concluded between www.dampol.eu Piotr Damme and the Customer via the store's website;
7. Act on Special Conditions of Consumer Sales – the Act of July 27, 2002, on Special Conditions of Consumer Sales and the Amendment of the Civil Code (Journal of Laws No. 141, Item 1176, as amended);
8. Act on the Provision of Electronic Services – the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws No. 144, Item 1204, as amended);
9. Order – a declaration of intent by the customer directly aimed at concluding a sales contract, specifying in particular the type and quantity of goods.
II. General Provisions
2.1. These provisions define the rules for using the online store at www.dampol.eu.
2.2. These provisions are the provisions in Article 8 of the Act on the Provision of Electronic Services.
2.3. The online store at www.dampol.eu is operated by P.P.U.H. DAMPOL Piotr Damme, ul. Tysiąclecia 1, 13-240 Iłowo-Osada.
2.4. These regulations define, in particular:
a) rules for registering and using an account as part of the online store;
b) conditions for making electronic reservations of products as part of the online store;
c) conditions for submitting orders electronically as part of the online store;
d) rules for concluding sales contracts for the use of services provided through the online store.
2.5. To use the online store, the customer must have access to a computer or terminal device with internet access.
2.6. In accordance with applicable law, P.P.U.H. DAMPOL reserves the right to restrict access to services through its online store to individuals under 18 years of age. Potential customers will be notified in such cases.
2.7. Customers may access, download, and print these terms and conditions at any time via the link on the homepage of the website www.dampo.eu.
2.8. Information regarding the goods offered on the store's websites, in particular their descriptions, technical and performance parameters, and prices, constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code.
III. Rules for Using the Online Store
3.1. Registration is required to use the online store.
3.2. Registration is completed by filling out and accepting the registration form, which is available on one of the store's websites.
3.3. Registration requires acceptance of these terms and conditions and the provision of personal data marked as mandatory.
3.4. P.P.U.H. DAMPOL Piotr Damme may revoke a customer's right to use the online store and restrict their access to some or all of the online store's resources with immediate effect if the customer violates these terms and conditions, in particular if the customer:
a) during registration in the online store, they provided untrue, inaccurate, or outdated information that misleads or infringes the rights of third parties;
b) has violated the personal rights of third parties via the online shop, in particular the personal rights of other customers of the online shop,
c) engages in other conduct that is not in accordance with applicable laws or general principles of internet use or that damages the good name of P.P.U.H. DAMPOL Piotr Damme.
3.5. A person whose right to use the online shop has been revoked may not register again without the prior consent of P.P.U.H. DAMPOL Piotr Damme.
3.6. To ensure the security of the transmission of messages and data related to the services provided on the website, the online shop takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent the unauthorized collection and modification of personal data transmitted on the internet.
3.7. The customer is specifically obligated to:
a) not provide or transmit any legally prohibited content, such as content that promotes violence, defames others, or infringes on personal rights and other rights of third parties;
b) use the online store in a manner that does not impair its functionality, in particular through the use of specific software or devices;
c) not engage in actions such as sending or publishing unsolicited commercial information (spam) as part of the online store;
d) use the online store in a manner that is not inconvenient for other customers or for P.P.U.H. DAMPOL Piotr Damme;
e) use content in the online store only for personal use;
f) use the online store in a manner that complies with the provisions of the law applicable in the territory of the Republic of Poland, the provisions of regulations, and the general principles for internet use.
IV. Procedure for Concluding a Purchase Agreement
4.1. To conclude a purchase agreement via the online store, visit the website www.dampol.eu, select the goods, fill in the order details, and rate them. Follow the subsequent steps based on the messages displayed to the customer and the information available on the website.
4.2. The customer selects the desired goods by adding them to the shopping cart.
4.3. During the ordering process—until the "Place Order" button is clicked—the customer can modify the entered data and the selected goods. To do so, follow the messages displayed to the customer and the information available on the website.
4.4. After the customer has provided all the required data in the online store, a summary of the placed order will be displayed. The order summary contains information on:
a) the subject of the contract,
b) the unit and total price of the ordered products or services, including shipping costs and any additional charges,
c) the selected payment method,
d) the selected shipping method,
e) the delivery time,
f) the number(s) to be added.
4.5. To submit an order, it is necessary to accept the terms and conditions, provide the personal data marked as mandatory, and click the "Order" button.
4.6. Submitting the order constitutes a declaration of intent to conclude a purchase agreement with P.P.U.H. DAMPOL Piotr Damme in accordance with the regulations.
4.7. After placing an order, the customer receives an email titled "www.dampol.eu Confirmation of Receipt of Order [No.]", which contains final confirmation of all essential elements of the order.
4.8. The contract is considered concluded upon receipt of the aforementioned email.
4.9. The purchase contract is concluded in German and Polish in accordance with the applicable provisions.
V. Delivery
5.1. Goods will be delivered within the European Union to the address provided by the customer when placing the order.
5.2. Ordered goods will be delivered by courier, postal service, and additional transport provided by the seller. Shipping costs will be indicated at the time of ordering.
5.3. Delivery time is 1 to 30 working days from the date the customer submits the order. The delivery time may change, and the customer will be notified at the provided email address.
5.4. Customers can access, download, and print these terms and conditions at any time via the link on the homepage of the website www.dampol.eu.
5.5. The consolidation, security, disclosure, and confirmation of the essential terms of the contract for the sale of goods to the customer will be sent to the provided email address and attached to the shipment containing the goods a printed copy of the confirmation, order specifications, and invoice showing the VAT.
VI. Prices and Payment Methods
6.1. The prices of the goods are quoted in EURO and include all components, including VAT (including the applicable tax rate), customs duties, and all other charges.
6.2. The customer has the option to pay the price:
a) by bank transfer to the specified account number (courier, postal service)
b) in cash (additional transport service provided by the seller)
VII. Complaints about the Goods
7.1. P.P.U.H. DAMPOL Piotr Damme, as the seller, is liable to the customer, who is a consumer within the meaning of Article 22 [1] of the Civil Code, for non-compliance with the agreement for the sale of goods purchased by that consumer to the extent stipulated by law under certain conditions of consumer sales.
7.2. Complaints arising from the violation of the customer's rights guaranteed by law or under these provisions should be sent to bestellung-24@wp.pl. I undertake to examine each complaint within 14 days and, if this is not possible, to inform the customer of the deadline within which the complaint will be addressed.
VIII. Irregularities in the Provision of Electronic Services and Reporting
8.1. P.P.U.H. DAMPOL Piotr Damme will take steps to ensure the proper functioning of the store, to the extent possible with current technical knowledge, and undertakes to rectify any irregularities reported by customers within a reasonable timeframe.
8.2. The customer is obligated to inform P.P.U.H. DAMPOL Piotr Damme of any irregularities or malfunctions of the online store website.
8.3. Irregularities related to the store's operation may be reported by the customer in writing to the following address: P.P.U.H. DAMPOL Piotr Damme, ul. Tysiąclecia 1, 13-240 Iłowo - Osada, or by email to info@kotfluegel.eu.
8.4. In the notification, the customer should provide their first and last name, correspondence address, the nature of the irregularity, and the date of the issue.
8.5. P.P.U.H. DAMPOL Piotr Damme undertakes to address every complaint. within 14 days and, if this is not possible, to inform the customer during this period when the complaint will be reviewed.
IX. Final Provisions
9.1. Disputes between P.P.U.H. DAMPOL Piotr Damme and a customer who is a consumer within the meaning of Article 22(1) of the Civil Code will be submitted to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure.
9.2. Disputes between P.P.U.H. DAMPOL Piotr Damme and a customer who is not a consumer within the meaning of Article 22(1) of the Civil Code will be subject to the jurisdiction of the courts responsible for the registered office of P.P.U.H. DAMPOL Piotr Damme.
9.3. In matters not covered by this Regulation, the provisions of the Civil Code, the provisions of the Act on the Provision of Electronic Services, and other relevant provisions of Polish and/or European law will apply.
All sales regulations presented in these regulations are translated from Polish and any inconsistencies related thereto will, as a rule, be resolved under Polish law (taking precedence over European law).
